Protecting the Interests of Healthcare Providers

We counsel healthcare business owners about their employment practices and particular issues for the purpose of ensuring fairness and legal treatment of personnel and to minimize their risks of employment-related litigation expense or liability. For example, our firm regularly advises healthcare employers with regard to how they use background screening to qualify job applicants. Background checks can implicate issues under federal anti-discrimination laws and state credit protection laws that establish legal parameters for such screenings. Every employer should consult with a qualified attorney to carefully review background screening policies and practices to ensure legal risks associated with background checks are limited and monitored.

Another area in which our firm commonly represents healthcare employers is restrictive covenants. Our firm has experience reviewing and preparing non-compete agreements, non-solicitation agreements, non-disclosure agreements and confidentiality agreements. The law in Georgia was recently changed concerning non-compete agreements, and all Georgia non-compete agreements should be reviewed by an experienced Georgia business and employment law attorney to determine whether changes need to be made to existing agreements in light of the transformation of Georgia law in this area.

Another part of our firm’s business practice is business litigation for healthcare providers involving, for example, contract disputes with insurers, claim denials by insurers, managed care issues, and appropriation of physician proprietary rights. Our firm also represents business in tort litigation, including claims for fraud, breach of fiduciary duty, defamation or slander, and shareholder derivative actions in the CSRA.

The CSRA comprises a region in eastern Georgia and western South Carolina divided by the Savannah River. The CSRA includes 18 counties. The Georgia counties within the CSRA are Burke, Columbia, Glascock, Hancock, Jefferson, Jenkins, Lincoln, McDuffie, Richmond, Taliaferro, Warren, Washington and Wilkes. The South Carolina counties within the CSRA are Aiken, Edgefield, Allendale, Barnwell and McCormick. The CSRA has a population of about 700,000. The principal cities in the CSRA are Augusta, Georgia; North Augusta, South Carolina; and Aiken, South Carolina.

Among other large employers, the CSRA is home to the Savannah River Site (SRS). SRS is a nuclear industrial complex operated by the United States Department of Energy. SRS spreads across more than 300 square miles located in Aiken, Barnwell and Allendale counties in South Carolina, near the Savannah River, which separates South Carolina and Georgia. The SRS has five nuclear reactors, two chemical separation plants, a cooling tower, various waste management compounds, and supporting offices, labs and buildings. Following the end of the Cold War, SRS has endeavored to transform its legacy as a “bomb plant” into new missions and continues to pursue nuclear solutions while dealing with the ongoing challenge of radioactive waste produced in earlier years.

The CSRA is also home to a strong medical industry, located in Aiken and Augusta. Augusta, for example, has numerous hospitals, physician groups, and other medical providers in a Medical District that employs over 25,000 people. Aiken also has a very strong healthcare presence of hospitals, physicians, elder care entities, and many other healthcare businesses.

The CSRA is also known for the annual Masters Golf Tournament in Augusta, which is (arguably) the greatest sporting event in the world. The “Masters” occurs annually on Thursday-Sunday, the first full week of April, at the acclaimed Augusta National Golf Club. During the tournament, many thousands of guests from all over the world descend upon Augusta and the CSRA to see the best golfers in the world compete for the coveted Green Jacket. Augusta and Aiken host numerous other sporting events.
